The Public Contracts Law is the fundamental law with regard to public procurement in Angola and plays a key role in the legal framework for Public-Private Partnerships. In fact, the PPP Regulation determines that the procedure applicable to the launch phase of Partnerships is, by express reference in article 14, the Public Contracts Law. This law provides for a set of pre-contractual procedures intended to be used by both public purchasers and co-contractors. These are the pre-contractual procedures that should be used to structure and launch the partnership, in particular to determine the choice of private partners. The Public Contracts Law also regulates the stages of each of these pre-contractual procedures in terms of their formal and organic elements, such as the indication of the parts of the procedure, the elements of the tenders, their presentation and deadlines.
