The Regulation of the PPP Law is the statute that develops and details the procedural structure of PPPs, also developing the governance model provided for in the Law, which must be articulated with the competencies currently provided for the DNPPP in its own Internal Regulations. In this regard, a “Public-Private Partnership Governance Body” is provided for, entrusted with the main decision-making powers set out in the PPP Law and the Regulation itself, as well as a Technical Committee for Public-Private Partnerships, which must be coordinated with the National PPP Directorate. In procedural terms, the preparatory phase is detailed, focusing on the pre-feasibility study, the various stages of the PPP launch phase are also developed and the existing obligations and competencies in PPP operation are detailed, both with the overall monitoring of Public-Private Partnerships and with the provision of rules on supervision, transparency and publicizing PPPs.
